1. Agreement to Terms

By accessing or using the EAS Custom App (“App”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of the Terms, you may not access or use the App. These Terms apply to all visitors, users, and others who access or use the App.

2. Use License

Elite AI Solutions grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. This license is subject to these Terms and does not include:

a) The right to modify, distribute, sell, or lease any part of our App. b) The right to reverse engineer or attempt to extract the source code of our App. c) The right to use our intellectual property for any commercial purpose without our express written consent.

3. Intellectual Property Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Elite AI Solutions, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4. User Account

4.1 You may be required to create an account to access certain features of the App. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account.

4.2 You agree to accept responsibility for all activities that occur under your account or password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

5. User Representations

By using the App, you represent and warrant that:

a) You have the legal capacity and agree to comply with these Terms. b) You are not under the age of 13. c) You are not a minor in the jurisdiction in which you reside, or if you are a minor, you have received parental permission to use the App. d) You will not access the App through automated or non-human means, whether through a bot, script, or otherwise. e) You will not use the App for any illegal or unauthorized purpose. f) Your use of the App will not violate any applicable law or regulation.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

a) Copying, distributing, or disclosing any part of the App in any medium, including by any automated or non-automated “scraping”. b) Using any automated system, including but not limited to “robots,” “spiders,” “offline readers,” etc., to access the App. c) Transmitting spam, chain letters, or other unsolicited email. d) Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the App. e) Taking any action that imposes, or may impose at our sole discretion, an unreasonable or disproportionately large load on our infrastructure. f) Uploading invalid data, viruses, worms, or other software agents through the App. g) Impersonating another person or otherwise misrepresenting your affiliation with a person or entity. h) Interfering with the proper working of the App. i) Bypassing the measures we may use to prevent or restrict access to the App.

7. Disclaimer of Warranties

7.1 The App is provided on an “AS IS” and “AS AVAILABLE” basis. Elite AI Solutions expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.2 Elite AI Solutions makes no warranty that the App will meet your requirements, be available on an uninterrupted, secure, or error-free basis, or be accurate, reliable, free of viruses or other harmful code, complete, legal, or safe.

8. Limitation of Liability

8.1 To the maximum extent permitted by applicable law, in no event shall Elite AI Solutions or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, business interruption, personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the App), even if Elite AI Solutions or any supplier has been advised of the possibility of such damages.

8.2 Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Elite AI Solutions and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of:

a) Your use and access of the App, by you or any person using your account and password. b) A breach of these Terms. c) Your violation of any term of these Terms. d) Your violation of any third-party right, including without limitation any copyright, property, or privacy right.

10. Termination

10.1 We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

10.2 If you wish to terminate your account, you may simply discontinue using the App.

10.3 All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
